Where the male or female form is used in the contractual provisions, it is solely for linguistic simplification. The regulations apply equally and in a gender-neutral manner to individuals of all genders.
All EMS rates listed in the “PERSONAL TRAINING” field on the front side (Economy, Basic, Flex) entitle the customer, upon contract completion, to participate once a week for 20 minutes in EMS training (Electro Muscle Stimulation) under the supervision of studio personnel. Training is scheduled by prior appointment. Once appointments are made, they can be rescheduled up to 24 hours before the scheduled time for a later time in the training week. If a customer’s request to reschedule is made too late or no appointment is made by the customer during a training week, the customer’s right to attend the training session in that week expires, unless an appointment was not possible due to reasons beyond the customer’s control. In such cases, the customer can request that the training session be rescheduled for a later time.
The cost of the start package, payable once upon contract initiation, includes comprehensive initial consultation for EMS training, monthly body analysis, and the programming and provision of a personalized training card for the customer.
Through the QR code provided in this field, the customer can, if desired, book a nutrition course with an external provider. This field merely serves as a reference to an offer from a third-party provider. The contractual regulations for the respective offer are governed by the terms of that provider. Terra sports is neither a contracting party for this offer nor responsible for the costs arising from the course booking.
In the “SERVICES” field, the customer can choose whether to purchase the necessary EMS training clothing or receive clothing on a rental basis during training visits. If the “Training Outfit” option is chosen, the customer purchases the clothing. If the customer chooses the “Comfort Service” option, terra sports provides clothing, socks, and towels for each training session. If the Comfort Service is chosen, it runs for the duration of the main tariff selected in the “PERSONAL TRAINING” field.
In the “SPECIAL AGREEMENTS” field, individual contract supplements or other special contractual agreements can be recorded in written or text form if the customer wishes.
The selectable term contracts in the “PERSONAL TRAINING” field each start on the contract start date indicated on the front side. If the contract start field is not filled out, the contract begins on the day of the signature date. Within the EMS training rates, terra sports offers the customer 3 term variants named “Economy,” “Basic,” and “Flex” on the front side. All contracts initially run for the specified duration indicated in the respective fields, calculated from the entered contract start date or, if a contract start date is not separately entered, from the signature date. If the contracts are not terminated with one month’s notice before the end of the selected contract term, they automatically extend indefinitely, including the Comfort Service if selected, and can then be terminated at any time with one month’s notice. All terminations must be in writing. The date of receipt of the termination statement is decisive.
The costs of the start package and, if chosen, the training outfit are due upon contract completion. The weekly amounts specified on the front side, within the tariff selection, and if chosen, the Comfort Service are due every Monday, starting on the first Monday following the contract start defined in point C, unless the contract start is a Monday; in such cases, the first weekly amount is due on the contract start date.
All amounts specified on the front side include the statutory value-added tax, currently at 19 percent.
Changes to the customer’s name, address, and bank details must be promptly communicated to terra sports.
The customer’s usage rights under this agreement are transferable only with the explicit consent of terra sports.
The statutory warranty regulations apply.
Terra sports does not participate in a dispute resolution procedure before a consumer arbitration board. However, the Alternative Dispute Resolution Act in Consumer Matters requires that the customer is still informed about a consumer arbitration board competent for them.
